This Offer (“Offer”) regulates the terms of use of the EXPRESS.MARKET platform (“Platform”) by buyers (“Buyer”) and defines the procedure for interaction with sellers and delivery operators. The Platform is managed by INTERNATIONAL DIGITAL RETAIL S.R.L., a company registered under the laws of Romania, with its legal address at: Strada Povestei, nr. 10, Com.1, Mod 02/02, Sector 4, Bucharest, Romania, CUI: 48149668, J40/3366/2023 (“Administration” or “Operator”).

1. General Provisions
1.1. The EXPRESS.MARKET Platform is an IT infrastructure that provides technical, informational, and marketing support for interaction between the Buyer, the Seller, and the Logistics Operator.
1.2. The Administration acts solely as an agent providing electronic commerce and delivery organization tools. It is not a party to the sales or shipping contracts.
1.3. The Buyer's use of the Platform constitutes acceptance of the terms of this Offer.

2. Ordering Goods
2.1. The Buyer may place an order for goods listed on the Platform by third parties (Sellers).
2.2. Placing an order constitutes a sales agreement between the Buyer and the Seller, without the Administration being a party to the transaction.
2.3. Information about the Seller is displayed on the product page or in the order.

3. Payment and Delivery
3.1. The Platform provides a payment gateway and technical capability for transferring funds from the Buyer to the Seller.
3.2. The fact of payment receipt by the Platform does not imply ownership of the goods by the Platform.
3.3. Delivery is carried out by third-party Logistics Operators engaged under agreements with the Administration.
3.4. Responsibility for delivery and compliance with the order lies with the Seller and/or the Logistics Operator.

4. Returns and Complaints
4.1. Returns are processed in accordance with the EXPRESS.MARKET Return Policy and applicable EU and Romanian law.
4.2. All claims regarding product quality or non-compliance must be submitted directly to the Seller.
4.3. The Platform may facilitate communication between parties but is not obligated to compensate losses.

5. Restrictions and Prohibitions
5.1. It is prohibited to list or sell on the Platform:
• counterfeit or fake goods;
• goods prohibited under EU law;
• goods that infringe the rights of third parties.
5.2. The Administration reserves the right to remove any items that violate legislation or Platform terms.

6. Legal Guarantees and Liability
6.1. The Administration is not a party to the transaction and is not responsible for:
• the quality, quantity, or conformity of the goods;
• fulfillment of delivery obligations;
• order fulfillment deadlines.
6.2. The Seller must provide proof of product compliance (certificates, declarations, licenses) when required.
6.3. The EXPRESS.MARKET Platform is not obligated to refund the Buyer if the Seller fails to process a return.

7. Personal Data
7.1. Buyer’s personal data is processed in accordance with the EXPRESS.MARKET Privacy Policy and Data Protection Policy, prepared under Regulation (EU) 2016/679 (GDPR).

8. Governing Law and Jurisdiction
8.1. This Offer is governed by the laws of Romania and the European Union.
8.2. All disputes shall be resolved in the competent courts of Romania.
