TERMS OF USE

This Terms of Use agreement (“Agreement”) governs the conditions for using the EXPRESS.MARKET e-commerce platform (“Platform”) and is entered into between You (“User”) and the company INTERNATIONAL DIGITAL RETAIL S.R.L., a legal entity registered under the laws of Romania, with its office located at: Strada Povestei, nr. 10, Com.1, Mod 02/02, Sector 4, Bucuresti, Romania, CUI: 48149668, J40/3366/2023 (hereinafter referred to as the “Administration” or the “Platform Operator”).

  1. General Provisions

 

1.1. By using the EXPRESS.MARKET Platform, the User confirms that they have read this Agreement, understand its content, and accept all the terms outlined herein.

1.2. The Platform provides infrastructure for listing, promoting, and selling goods by third-party sellers.

1.3. The Administration is not the seller of goods listed on the Platform, but acts as an intermediary providing marketing, technical, and infrastructure services.

  1. Registration and Account

 

2.1. To access the Platform’s functionality, the User must complete the registration process, provide accurate data, and confirm acceptance of this Agreement.

2.2. The User is responsible for the security of their account access credentials and all actions taken using their account.

  1. Role of the Platform

3.1. The Platform Administration provides the technical ability to post product information, place orders, make payments, and use logistics services.

3.2. Responsibility for the completeness, quality, safety, and legality of the goods sold lies solely with the seller.

3.3. The Administration is not a party to transactions between the seller and the buyer.

  1. Payments and Fees

 

4.1. All settlements between buyers and sellers are made using the payment system integrated into the Platform.

4.2. The Administration may charge fees for services provided within the Platform. The amount and conditions of the fees depend on the seller’s category and the type of goods and are specified in the seller’s personal account.

4.3. Additional paid services (marketing, analytics, etc.) are provided upon request and arranged individually.

  1. Use and Restrictions

 

5.1. The User agrees not to post any information on the Platform that violates Romanian, EU, or international law.

5.2. It is prohibited to use the Platform for illegal trade, including but not limited to counterfeit goods, unlicensed products, prohibited substances, etc.

  1. Intellectual Property

 

6.1. All design elements, source code, logos, and content of the Platform (excluding user-generated content) are the intellectual property of the Administration and are protected by copyright law.

  1. Liability

 

7.1. The Administration is not responsible for the actions of users, sellers, or third parties ordering or providing goods.

7.2. In the event of a dispute between a seller and a buyer, the Platform may assist in resolution but is not obliged to compensate for any losses.

7.3. The User agrees to indemnify the Administration for damages incurred as a result of violating the terms of this Agreement.

  1. Personal Data Processing

 

8.1. Personal data is processed in accordance with the Privacy Policy, prepared in compliance with Regulation (EU) 2016/679 (GDPR).

  1. Applicable Law and Jurisdiction

 

9.1. This Agreement is governed by the laws of Romania and the European Union.

9.2. All disputes shall be resolved in the competent courts of Romania.

  1. Amendments

 

10.1. The Administration reserves the right to make changes to this Agreement. The new version becomes effective upon its publication on the Platform.
